This contest is sponsored and administered by Jovani Fashions Ltd., located at 1370 Broadway, 4th Floor, New York, NY 10018 (“Jovani”). (“Jovani”).

By entering this contest, contestants automatically agree to be bound by the terms and conditions (“Terms & Conditions”) of this contest as listed herein..

Terms & Conditions:

Dates of Promotion:

The contest will begin on Tuesday, June 7th, 2016 and ends Monday June 27th, 2016 at 6pm EST (“Promotion Period”). Please note that this date may be extended in accordance to Jovani’s needs. The winning finalists will be announced on Jovani.com on or by Monday, July 4th, 2016. .

Who Can Enter:

Contestants must be between 15 and 27 years of age and must be legal residents of the United States (“Contestant”). All Contestants who are selected to participate and have not reached the legal age of 18 years as of the date of entry must submit a Parental Consent Form to be eligible.

How to Enter:

During the Promotion Period, contestants must enter the contest by completing the form on http://www.jovani.com/jovani-it-girl

Only one (1) entry per valid email address will be accepted.

Contestant must post images on their Instagram using the hashtags #jovaniitgirl #jovani

Contestants must also “like” Jovani Fashions’ official Facebook page and follow @JOVANIFASHIONS and @JOVANIITGIRL on Instagram.

Valid entries must contain all information requested and must be received on or before the deadline for registration to be considered valid.

Jovani is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, hardware or software errors, computer difficulties, delayed electronic transmissions and other technological problems. Jovani is not responsible for incomplete entries or typos.

All potential winners are subject to verification by Jovani before any selection is made. An entrant is not a winner of any prize, unless and until their eligibility has been verified.

How to Win:

50 Contestants will be selected to model on Jovani’s runway and showroom at Atlanta Mart 2016 every day from July 30th to August 8th. Jovani will be responsible for Contestant’s transportation to and from Atlanta, lodging and meals for these dates only. Jovani will not provide transportation to and from the airport; Contestants will be responsible for their own transportation to arrive and depart the hotel.

Based on Contestant’s overall performance in Atlanta, Jovani will select 10 finalists (“Finalists”) who will participate in a photo shoot for Jovani’s 2017 best styles and Jovani’s coterie week. These events will take place in New York tentatively from September 18th to September 23rd, 2016 (Confirmation of actual dates will be provided on or by July, 2016). Jovani will be responsible for Contestant’s transportation to and from New York, lodging and meals for these dates only. Jovani will not provide transportation to and from the airport; Contestants will be responsible for their own transportation to arrive and depart the hote.

Contestants will be sent to Atlanta on July 30th and sent home on August 8th.

The 10 finalists will be announced on or by August 22, 2016.

Jovani will select 1 grand winner (“Jovani It Girl”) and 3 runner-ups based on the Finalists overall performance in Jovani’s photoshoot and coterie fashion shows. Finalists who are not selected will be sent home on or by September 21st, 2016 and will be awarded a consolation prize that will not exceed the retail value of one thousand five hundred dollars ($1500).

On or by September 23rd, 2016 Jovani It Girls will be sent home.

All winners will be announced on Jovani.com and Jovani’s social media pages.

Eligibility:

Contestants in Alaska, Hawaii, or any of the US Territory Islands will not be considered

Contestants must be at least 15 years of age as of the date of entry and legal residents of the United States.

If any Contestants transportation and lodgings produces undue hardship and costs to Jovani, Jovani reserves the right to cancel the prizes. No substitution or compensation shall be awarded.

Prizes:

The Jovani It Girl will be awarded a scholarship and will be pronounced a Jovani Instagram Ambassador.

All scholarships will be awarded directly to the winners’ educational institution or creditor. The cost or value of each scholarship shall not exceed five thousand dollars ($5,000)..

o The Jovani It Girl winner will receive a custom made Jovani dress designed by Jovani’s head designer that will not exceed the retail value of ten thousand dollars ($10,000).The three runner-ups will receive a dress that will not exceed the retail value of two thousand five hundred dollars ($2,500).

o All Contestants who are chosen to participate in the Atlanta Market will be awarded a Jovani dress that will not exceed the value of seven hundred and fifty dollars ($750).

All winners will participate in a photoshoot on September, 2016 for editorials that may potentially be featured on Teen Vogue, Seventeen Magazine, Seventeen Prom and Teen Prom.

Prizes may not be sold, traded, or commissioned and are not exchangeable, transferable or redeemable for cash except in Jovani’s sole discretion. If any Contestant or Finalist is disqualified or found to be ineligible for the contest, Jovani reserves the right to determine an alternate winner or not to award the prize, at its sole discretion.

ALL PRIZES ARE AWARDED “AS IS” AND WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE), AND ALL SUCH WARRANTIES ARE HEREBY DISCLAIMED.

Cancellation Penalty:

o In the event of Contestant’s withdrawal or cancellation after Contestant is selected to participate in one or all rounds, Contestant shall be charged all expenses incurred by Jovani to the credit card provided by Contestant in the Participation Confirmation Form..

Disclaimers:

Jovani reserves the right to cancel, terminate, modify, amend, extend or suspend the contest at any time without giving any prior notice to any party.

The selection made by Jovani to participate or win this contest does not guarantee the possibility of employment with Jovani at any time. No employment offer will be considered for any Contestant.

Jovani reserves the right to disqualify and prohibit from participating any individual who Jovani determines is or is attempting to (i) tamper with Jovani’s website and/or any part of the contest, (ii) intending to annoy, abuse, threaten or harass any other participants or Jovani’s agents or employees; and/or (iii) otherwise violating these Terms & Conditions.

Unlimited use:

All pictures produced by Jovani in this contest shall be for unlimited use by Jovani, its affiliates, departments, partners and the like, including, but not limited to, advertising, promotions, editorials, documentaries, broadcasts and any other publication.

Full and unlimited copyrights and ownership to all pictures of this contest shall be held by Jovani in accordance with any applicable law, including U.S. Copyright Act 17 U.S.C §201(b) and §101. Except as otherwise prohibited or restricted herein, Contestants shall have the right to use the images taken of them in the Contestants own personal portfolio with Jovani’s prior written consent. Contestants agree that at no time will the Jovani name, nicknames, logos or symbols or any other identifying marks, be used in commercials, advertisements or any other personal publication or broadcast without the Jovani’s prior written consent.

Use of Personal Information:

Jovani will retain Contestant’s personal data for a reasonable period of time to enable it to communicate and coordinate with all winners with respect to the logistics of each event. This data may be passed to a third party solely to enable such third party to fulfill any necessary requirements relating to the transportation, lodging and/or delivery of a prize or for the coordination of all events with the subsequent venues.

By participating, where allowed by law, all winners grant Jovani exclusive permission to announce their name on Jovani.com and on Jovani’s official social media pages.

Releases:

By participating in the contest, each Contestant and winner waives any and all claims of liability against Jovani, its employees and agents, any applicable third party fulfillment service, and each of their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the contest, or from the award, receipt and/or use or misuse of any prize.

Jovani, and its respective employees and agents shall not be liable for any loss, damage or any injury that may be sustained by anyone at any of the subsequent events or in connection with this contest.

Miscellaneous:

Contest is null and void in any jurisdiction where prohibited by law.

No purchase or payment of any kind is necessary to enter or win.

Participation in the Contest constitutes entrant’s full and unconditional agreement to, and acceptance of these Terms & Conditions. Winning a prize is contingent upon entrant’s fulfillment of all requirements set forth herein.
